Talking to the police officer
- The first thing your Phoenix dui attorney wants you to know is that every statement you make will be repeated in court.
- The police officer will ask you "have you been drinking?" Any answer other than 'no" will result in the person who is pulled over taking a field sobriety test. However in court the Prosecutor will discredit you by telling the jury that you lied to the police officer and make a big deal out of this. Therefore consider your words wisely. If you are going to admit to drinking then do so, but changing your story later does not help. If you do tell the officer that you had not been drinking an alternative answer to "I lied" is that "I panicked". A jury can understand that being pulled over especially after a few beers is very stressful.
- Take note – does the officer have a video camera in his/her car? Your phoenix dui attorney will need to know this. Is the officer going to record the stop? If the officer has a video camera but does not record the stop this will look bad to a jury, as they would like to make up their own minds, and the police officer will have to explain this. Do not expect a police officer to be completely honest on the stand, most but many just can’t remember details. Make a mental note of this during the stop.
- If the officer states that you have blood shot or red eyes – if you have allergies at this point explain that is what the issue is. Your phoenix dui attorney will want to be able to challenge the police officers testimony.
